1. This question relates to matters that are regulated by the Therapeutic Goods Administration (TGA), which is responsible for regulating the supply, import, export, manufacturing and advertising of therapeutic goods, medical devices and medicines.
2. This question should be directed to the TGA.
3. While the ACCC may take action under the Australian Consumer Law for conduct in trade or commerce which it considers is capable of reaching the legal threshold of being misleading and deceptive or likely to mislead or deceive, it generally does not become involved in matters that are within the remit of industry specific regulators that have the regulatory focus and expertise to better deal with the conduct. However, the ACCC does engage closely with such regulators, which includes the TGA, to share information and intelligence on related issues.
